1. Acceptance of Terms

By accessing or using CalimaticMail ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

CalimaticMail provides professional email hosting services including but not limited to:

  • Custom domain email hosting
  • Email sending and receiving via SMTP/IMAP
  • Web-based email client access
  • RESTful API for email operations
  • Email templates and automation
  • Administrative tools and analytics

3. Account Registration

To use our Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  • You must be at least 18 years old to create an account
  • You must provide a valid email address for verification
  • You are responsible for all activity on your account
  • You must notify us immediately of any unauthorized access

4. Acceptable Use Policy

You agree not to use the Service to:

  • Send unsolicited bulk email (spam)
  • Send emails containing malware, viruses, or malicious content
  • Engage in phishing or fraudulent activities
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Harass, abuse, or harm other users
  • Attempt to gain unauthorized access to systems
  • Interfere with or disrupt the Service

We reserve the right to suspend or terminate accounts that violate this policy.

5. Service Plans and Billing

5.1 Subscription Plans

We offer various subscription plans with different features and limits. Details of each plan are available on our pricing page.

5.2 Payment Terms

  • Subscriptions are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • Prices may change with 30 days notice
  • Failed payments may result in service suspension

5.3 Free Trial

Free trials may be offered at our discretion. At the end of a trial period, you will be automatically enrolled in a paid plan unless you cancel.

6. Service Level Agreement

We commit to maintaining 99.9% uptime for our email services. This excludes scheduled maintenance and circumstances beyond our control. Service credits may be available for extended downtime as detailed in our SLA.

7. Data Ownership and Portability

  • You retain ownership of all data you upload to our Service
  • We do not claim ownership of your email content
  • You may export your data at any time using our export tools
  • Upon termination, you have 30 days to export your data

8. Intellectual Property

The Service and its original content, features, and functionality are owned by CalimaticMail and are protected by international copyright, trademark, and other intellectual property laws.

9. Third-Party Services

Our Service may integrate with third-party services. Your use of such services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

10. Limitation of Liability

To the maximum extent permitted by law, CalimaticMail shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total liability shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless CalimaticMail from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

Either party may terminate this agreement at any time. Upon termination:

  • Your access to the Service will be disabled
  • You will have 30 days to export your data
  • Outstanding fees remain payable
  • Provisions that should survive termination will remain in effect

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Continued use after changes constitutes acceptance of modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CalimaticMail operates, without regard to conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be addressed through good-faith negotiation. If resolution is not reached, disputes will be resolved through binding arbitration.
